Terms of Service
Effective August 15, 2026
These Terms of Service apply to website design and development services provided by New Tab. By approving a project quote or asking New Tab to begin work, the client agrees to the terms that apply to that project.
1. Services + pricing
New Tab offers custom website design and development services. The current Basic Website starts at $75 and includes one custom one-page website, mobile and desktop-friendly design, social/contact links, custom domain connection, and one revision. Optional pages and features are priced separately as listed on the Services page. Custom features may require an individual quote.
Pricing shown on the website is a starting point. The final project scope and total price will be confirmed before work begins.
2. Project scope
The agreed project scope determines what New Tab will build. Requests that significantly change the scope, add new pages, add new features, or require additional work may be quoted separately before that work is completed.
3. Client content + responsibilities
Clients are responsible for providing accurate business information, website copy, images, logos, links, and other materials needed for the project unless otherwise agreed.
By providing content to New Tab, the client confirms that they have permission to use it and that its use on the website does not knowingly violate another person’s intellectual-property or privacy rights.
4. Revisions
The Basic Website includes one revision round. A revision round means one organized set of requested changes submitted after the first complete version is presented. Additional revision rounds or major changes may be quoted separately.
5. Domains + third-party services
Domain registration costs are separate from New Tab’s website-design pricing. Any paid third-party services, subscriptions, booking platforms, ecommerce tools, fonts, plugins, or similar services required for a project are also separate unless the project quote says otherwise.
Third-party services operate under their own terms, policies, availability, and pricing. New Tab cannot guarantee the continued availability or performance of a third-party platform.
6. Payment
The payment schedule and accepted payment method for each project will be stated in the project quote, invoice, or written project agreement before work begins. New Tab may delay launch or final delivery until any payment due under that agreement has been received.
7. Timelines
Any project timeline is an estimate unless New Tab specifically agrees to a fixed deadline in writing. Delays in receiving client content, approvals, feedback, access, or other required materials may extend the timeline.
8. Ownership
After the client has paid the amount due for the completed project, the client may use the final custom website deliverables created specifically for that project. New Tab retains ownership of its pre-existing materials, reusable code, tools, processes, and general development techniques. Third-party materials remain subject to their original licenses.
9. Portfolio use
New Tab may display a completed project in its portfolio, social media, or promotional materials unless the client asks in writing before launch for the project to remain private.
10. Cancellations + refunds
Any cancellation, refund, or non-refundable payment terms will be stated in the project quote, invoice, or written project agreement before work begins. If no separate cancellation terms have been agreed, New Tab and the client will determine any amount due based on work already completed and expenses already incurred.
11. Website availability + warranties
New Tab will make reasonable efforts to deliver working website files and features according to the agreed project scope. Websites can depend on hosting providers, domain registrars, APIs, databases, browsers, devices, and other third-party systems, so uninterrupted operation cannot be guaranteed.
12. Limitation of liability
To the extent permitted by applicable law, New Tab is not responsible for indirect, incidental, special, or consequential losses arising from a project or from the failure of a third-party service. Any direct liability connected to a project will not exceed the amount the client paid New Tab for that project, unless applicable law requires otherwise.
13. Changes to these terms
These terms may be updated as New Tab’s services change. The version that applies to a client project is the version in effect when the project is agreed to, unless both sides agree otherwise.
